Man damaged ex's furniture as she tried to move out

Chesterfield magistrates’ court heard on Wednesday, February 17, how Thomas Tustin, 20, of Devonshire Street, Brimington, Chesterfield, had been in a relationship for 10 months before his ex Daniella Pashley decided to move out of their shared home.

Prosecuting solicitor Sarah Haslam said: “Daniella Pashley was in a relationship with the defendant for ten months and they were living in a privately rented house.

“She had moved out leaving her belongings at the house and he was angry that she had moved out.

“She returned with friends the following day to collect her belongings and he let her in but lost his temper.”

The court heard how he threw things downstairs and damaged a TV and its stand.

He told police he had lost his job as a tree surgeon and was struggling to get benefits and was taking legal highs to help him relaxed.

Tustin admitted getting angry and smashing the complainant’s glass table top and throwing drawers and the TV downstairs.

He also apologised and said he wanted to pay for the damage.

Tustin pleaded guilty to causing criminal damage after the incident on January 31.

He told the court: “It was a stupid spitting my dummy out thing and I cannot take it back.”

Magistrates sentenced Tustin to a six-month conditional discharge but warned he would be resentenced for this offence if he committed any other crimes in the next six months.

He was also ordered to pay £85 costs and a £15 victim surcharge.
