Drunk man tried to break into his own home

High Peak Magistrates’ Court heard how a husband and wife were awoken at about 2.40am on January 16 by the sound of banging at their London Road home.

Jennifer Fitzgerald, prosecuting, said the husband looked outside and saw a man he did not know, who appeared to be very drunk and confused.

“He watched as the defendant approached the back door and began to kick out at it,” said Ms Fitzgerald.

Jason Thomas Daiken, 24, was seen to land about 20 kicks to the door.

Ms Fitzgerald said Daiken was abusive to officers when arrested, head-butted the back of the police vehicle and also head-butted concrete on arrival at Buxton custody suite, and had to be taken to hospital for treatment for his injuries.

Daiken admitted causing criminal damage when he appeared before magistrates on Monday.

James Riley, defending, said Daiken immediately offered to pay for the damage.

He urged magistrates to view the incident as a blip rather than any continuation of his client’s previous offending, for which he was complying well with an ongoing community order.

Daiken was sentenced to an 18-month conditional discharge and must pay £947 compensation, £85 prosecutions costs and a £15 government surcharge.
