Curfew for the man found to be carrying a lock-knife

A BUXTON man was given a 16-week curfew after he was found to have a lock-knife used for work in his pocket while out one evening.

Leon David Corbett, 24, Granby Road, Buxton admitted having a lock-knife with him in a public place without good reason or lawful authority.

John Cooper, prosecuting said on June 14, police had noticed three people in an alleyway off Lightwood Road on and spoke to the two men and a woman. The office said he intended to search the defendant and asked him is he had anything on him and he said a knife in his pocket.

Ian Baker, defending, said his client, who had no previous convictions or cautions, had been employed at Buxton Press and had been issued with the lock-knife and a digital measuring device as part of his work.

He had been to work on Friday had gone home and then gone camping returning home on Saturday to get washed and changed before going out.

He had put on the same top he had been wearing at work on Friday not realising the knife was in the pocket, until later in the evening.

Mr Baker said Corbett, a keen climber was not currently working as he had suffered serious injuries, severing a finger, after falling and had spent four days in hospital.

The court heard guidelines for offences of carrying a knife without a good reasons gave a starting point of custody.

Chairman of the bench David Dusgate said: "We think you realise Mr Corbett how seriously the courts take any carrying of a bladed or pointed weapon whatever the circumstances.

"We felt you had forgotten the item was in your possession, there was no attempt to use it, it was not premeditated and it was carried just on a temporary basis. It was a risk to public safety therefore we have decided on a community penalty in the high band.

"We have taken into account the fact there is no previous offending and there was some explanation for why you had it."

In addition to the 16-week curfew order, to remain indoors between 8pm and 7am, Corbett was also ordered to pay 30 costs.
